Where trust has broken down completely between two parties, or there are complicating factors such as complex financial entanglements, history of abuse, or addictions or mental health issues that would make the work of collaborative divorce or a mediated settlement difficult, litigation is the most effective option.

In litigation, each party retains a lawyer to advocate for their position in a lawsuit. The process may include court applications, affidavits, questioning, and settlement negotiations. Most divorce cases reach settlement before going to court. Some matters, however, may ultimately be decided by a judge through trial or other judicial dispute resolution methods.
